TERMS AND CONDITIONS OF HIRE
These Terms and Conditions form a legally binding agreement between Casa Fresa Accommodation Ltd (Company Number SC518791), 65 Monifieth Road, Broughty Ferry, Dundee, DD5 2RW (“Casa Fresa”, “we”, “our”, “us”) and the person making the booking together with all members of their party (“you”, “your”, “Guest”). By making a booking or staying at one of our properties, you agree to these Terms and Conditions.
1. Scope
Your stay is a short-term holiday or serviced accommodation booking only and does not create a tenancy, lease or any landlord and tenant relationship. Rates may change without notice until a booking is confirmed.
2. Agreement for Occupation
Bookings are for the named guests only. The lead guest must be at least 25 years old. We may refuse or cancel a booking for legitimate business reasons including fraud, safety concerns, previous misconduct or breach of these Terms. Check-in is from 3:00pm and check-out is by 10:00am unless otherwise agreed.
3. Payment
A 50% deposit is payable at booking and the remaining balance is due 30 days before arrival. Failure to pay may result in cancellation. Additional cleaning, smoking, pet or other charges may be charged to the payment card used for the booking.
4. Security Deposit
A Security Deposit may be taken before or during your stay. The Security Deposit may be used to cover damage, missing items, excessive cleaning, smoking, unauthorised pets, lost keys, additional occupancy charges, unauthorised guests or visitors, administration costs and any other reasonable loss or expense arising from a breach of these Terms.
5. Additional Charges
You authorise Casa Fresa to charge any Additional Charges to the payment card used to make the booking. Failure to pay an invoice within 14 days may result in debt recovery action and reasonable administration costs.
6. Changes to Your Booking by Us
If we need to cancel or materially change your booking, we will offer an alternative where possible or refund monies paid. We are not liable for events beyond our reasonable control including adverse weather, utility failures, pandemics, government restrictions or cyber incidents.
7. Cancellation by You
Cancellations made more than 30 days before arrival may be accepted in accordance with the booking terms. Cancellations within 30 days of arrival and no-shows are non-refundable unless otherwise agreed in writing.
8. Liability
Nothing in these Terms excludes liability for death or personal injury caused by our negligence, fraud or any liability that cannot lawfully be excluded. We are not liable for losses that are unforeseeable or outside our control.
9. Property Condition
Guests should inspect the property upon arrival and notify us within two working days of any issues. Failure to do so will be deemed acceptance of the property’s condition.
10. Keys and Access
Lost keys, lockouts and replacement locks may incur charges. We may enter the property in an emergency, to undertake essential maintenance or where we reasonably suspect a breach of these Terms.
11. Internet
Wi-Fi is provided as a complimentary service and is not guaranteed. We accept no responsibility for interruptions, data loss or cyber incidents affecting guest devices.
12. Maintenance Call-Outs
If a reported fault is found to be the result of incorrect operation of equipment or guest misuse, a call-out charge may apply.
13. Guest Obligations
Guests must keep the property secure, report damage promptly, behave respectfully and comply with all instructions provided. Parties and events are prohibited unless expressly authorised in writing. Guests must not engage in illegal activity, abusive behaviour or any activity causing nuisance to neighbours or staff.
14. Unauthorised Guests and Visitors
Only the number of guests declared at booking may occupy the property. A visitor is any person remaining at the property for more than one hour who is not named on the booking. Unauthorised guests or visitors may result in additional charges of £25 per person per night, termination of the booking without refund, retention of the Security Deposit and additional charges to the payment card.
15. CCTV and Noise Monitoring
CCTV may operate in communal areas and external entrances for security, fraud prevention and verification of occupancy levels. Certain properties may contain noise monitoring devices that measure noise levels only and do not record conversations.
16. Health and Safety
Guests must keep the property free from hazards and comply with all safety instructions. Smoking and vaping inside the property are prohibited. Illegal drugs are strictly prohibited.
17. Data Protection
Personal information is processed in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Further information is available in our Privacy Policy and Cookie Policy.
18. Complaints
Any issues should be reported immediately to give us the opportunity to resolve them during your stay. Written complaints should be submitted within 14 days of departure.
19. Chargebacks and Payment Disputes
Where a chargeback or payment dispute is raised, we reserve the right to provide evidence including booking confirmations, correspondence, identification documents, CCTV footage, photographs and housekeeping records to the relevant payment provider or dispute resolution body.
20. Governing Law and Severance
These Terms are governed by the laws of Scotland and the Scottish courts shall have exclusive jurisdiction. If any provision is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Definitions
Additional Charge means any charge payable in addition to the accommodation fee. Security Deposit means any deposit or card pre-authorisation held by Casa Fresa against losses or breaches of these Terms. Property means the serviced apartment booked by the Guest.
